6.1 Favorites

Some of our platforms allow you to bookmark your favorite content, so you can quickly and easily access it later. You can also use this feature to keep up to date with our new and upcoming content. This feature is an integral part of our content delivery and development process.

We also offer you the possibility of single sign-on for certain Lausanne City Football Club services.

You should note that by using some of our platforms and content, you also agree that your internet and connectivity resources may potentially be used by our service provider WIX ("WIX Provider"). 7. User Generated Content

7.1 What do we mean by "user-generated content"?

Our platforms offer a variety of features, which allow you to interact with us and the community by posting your own comments, news, texts, illustrations, data, files, images, graphics, photos, sounds, music, videos, information, content and/or other media and by liking, sharing and rating. All content contributed by you using these features is collectively referred to herein as “User Generated Content” or “UGC”.

7.2 Unlimited license for your UGC for the purposes of Lausanne City Football Club

In some cases, you or third parties may have copyright or other intellectual property rights in your UGC.

To the extent that you contribute to our platforms in the form of UGC, at the time of your participation, you grant us a worldwide, unlimited, irrevocable and non-expiring, free, transferable license to third parties to use your UGC in its entirety. Reach and extent by any means and in any medium and to create derivative works as well as to adapt, digitize, duplicate and otherwise exploit your UGC. In particular, this license also includes the use of UGC in advertisements and promotional campaigns and is in no way limited to the Platform on which the UGC was provided by you. You agree that you have no right or claim any fees or additional consideration for our use of the UGC.

Finally, you grant other users permission to access and use your UGC, reproduce it, like it and share it, create derivative works from it, display it and perform it publicly, to transfer and publish it to the extent permitted by the functionality of our Services and these Terms of Service.

7.3 Displaying and deleting the UGC

We have the right but not the obligation to monitor UGC. We have the right to modify, refuse, delete or block access to the UGC at our own discretion and for any reason.

7.4 Your personal information and UGC

You give us the right (but not the obligation) to use your biographical information, including but not limited to name, image, voice, biography, likeness, and geographic location in the for broadcast, print, online or other use.

7.5 UGC Terms and Conditions

Before we can allow you to contribute your UGC, you must agree to abide by the following rules. Accordingly, you covenant, represent and warrant that your UGC shall not:

• cast a negative light on Lausanne City FC or our businesses, businesses or brands. In particular, you are prohibited from using the following content in connection with your UGC: (a) illegal products, content, services or materials; (b) coverage for accidents, assaults, disasters or riots; and/or (d) competing products;

• be unlawful, threatening, racist, libelous, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, pornographic or otherwise objectionable, or otherwise violate any applicable law;

• encourage conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law;

• be an advertisement for goods or services or a solicitation of funds;

• allow the identification of personal information such as messages, telephone numbers, social security numbers, account numbers, addresses or employer references; Where

• contain a virus, Trojan horse or other harmful code or script.

Additionally, any conduct that we believe, in our sole discretion, restricts or inhibits any other user from using or enjoying our platforms or content will not be permitted.

7.6 Guarantees and indemnities

In order to ensure compliance with these rules and to protect our interactions, you provide us with the following guarantees and indemnifications regarding your UGC:

You acknowledge and agree that you are solely responsible for the UGC you submit. You represent and warrant that you are the owner of all rights to your UGC and that it does not violate or infringe any third party rights such as personality rights (in particular the right to one's own image), the rights of intellectual property such as trademarks, patents, copyrights or other proprietary rights protected by law.

You further represent and warrant that all required rights, approvals, permissions and waivers of rights have been properly obtained from each participant, actor, moderator, contributor or other persons involved in the UGC or related rights, services or institutions, and that you are permitted to exercise these rights at your own discretion and to the scope and extent provided herein.

You agree to indemnify Lausanne City Football Club and hold us fully and completely harmless from any third-party liability arising out of your uploading of your content and our use of it for the purposes stated at the time of uploading, due to your negligence or breach intentional of your warranties above.

8. Liability

​

We and our employees, distributors, licensors and representatives shall not be liable for our Free Content, whether in contract, tort (including without limitation negligence) or any other act or omission, whether such act or omission whether direct, indirect, consequential or specific. The exclusions set out in this section apply even if the loss or damage suffered by you was or should have been foreseen by us and/or if you informed us of the risk that you would suffer the loss or damage.

Nothing in these Terms of Use limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation or for any other type of liability which cannot be limited or excluded. by applicable law, or otherwise affect your rights as a consumer.
